Querixa operates the PowerMind service. You can contact us at support@querixa.com for customer enquiries or legal@querixa.com for legal notices. Compliance requests, including data processing agreements, can be directed to compliance@querixa.com.

1. Acceptance of Terms

By creating an account, purchasing a subscription, or otherwise accessing the Services, you agree to be bound by these Terms and our Privacy Policy. If you are acting on behalf of an organization, you confirm that you have authority to accept these Terms on its behalf.

2. Accounts and Eligibility

You must be at least 18 years old to use the Services. You are responsible for maintaining accurate account information and safeguarding your login credentials. Querixa is not liable for any loss arising from unauthorized use of your account that results from your failure to protect your credentials.

3. License Grant

Querixa grants you a limited, non-transferable, non-exclusive license to deploy PowerMind within the scope of the subscription plan you purchased. License keys and entitlements are tied to the email address and workspace defined in your account and may not be shared outside of your organization.

4. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the PowerMind visual or supporting APIs.
• Use the Services to infringe on intellectual property rights, violate applicable laws, or transmit harmful code.
• Share or resell license keys without written permission from Querixa.

5. Fees, Renewals, and Cancellations

Paid plans are billed in advance on the cadence displayed at checkout (monthly or annual). Subscriptions renew automatically until canceled. You may cancel at any time from the billing portal; access will remain until the end of the current billing period. Details on refunds are covered in our Refund Policy.

Payments are processed through 2Checkout (Verifone) and its payment partners. Applicable taxes will be added based on your billing location. Receipts and invoices are available in the billing portal or by emailing billing@querixa.com.

6. Data and Privacy

Querixa processes personal data in accordance with our Privacy Policy. By using the Services, you consent to that processing and acknowledge that it is necessary for us to provide the product experience.

7. Intellectual Property

Querixa retains all rights, title, and interest in the Services, including all software, documentation, and brand assets. You retain ownership of your content and feedback, but grant Querixa a worldwide, royalty-free license to use feedback for product improvement.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may modify or discontinue features with reasonable notice. Scheduled maintenance and emergency downtime may impact access to the Services.

9. Disclaimers

The Services are provided "as is" without warranties of any kind, whether express, implied, or statutory. Querixa disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

10. Limitation of Liability

To the extent permitted by law, Querixa's aggregate liability under these Terms will not exceed the fees you paid to Querixa in the six (6) months preceding the event giving rise to the claim. Querixa is not liable for indirect, consequential, special, or incidental damages.

11. Indemnification

You agree to indemnify and hold harmless Querixa, its affiliates, and employees from any claims or damages arising from your misuse of the Services or violation of these Terms.

12. Changes to Terms

We may update these Terms to reflect operational, legal, or regulatory requirements. Material changes will be communicated via email or in-app notification. Continued use after the effective date constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the applicable laws of the jurisdiction where Querixa is established. If any provision is held unenforceable, the remaining provisions will remain in effect to the fullest extent permitted.
